Terms and conditions

SALES POLICY

The purpose of these conditions is to define the general sales conditions established between Microgreens and the customer, from the moment of ordering to the various services provided by Microgreens, as well as the payment methods and delivery conditions of the merchandise. These conditions regulate all the necessary steps to place the order and ensure the follow-up of this transaction between the contracting parties.

 

REGISTRATION DATA

To place the order, the customer must provide personal data, including their name, address, taxpayer number, and other requested information.

For this, they must fill in all the required fields.

By placing their order, the customer expresses their knowledge and full acceptance of the general sales conditions, the prices, and the description of the products included in this transaction. These general sales conditions will be the only ones applicable between the two parties.

 

PRIVACY AND SECURITY POLICY

In compliance with Law No. 67/98, of October 26, on the Protection of Personal Data, we inform you that the processing of personal data collected on the www.microgreens.pt portal is the responsibility of Microgreens Unip Lda, headquartered at Quinta da Princesa, Estrada do Talaminho 2845-433 Amora, legal entity 513612254, fully committed to privacy and security in processing and maintaining each customer's personal data. Personal data is processed electronically and transmitted to transport companies for delivery purposes, as well as to our accounting department for invoicing purposes. The customer authorizes Microgreens to use their personal data for the purposes outlined here.

 

PRICING POLICY

The prices established in this virtual store are only valid for the day they are announced, remaining in effect for the customer who orders on that date. All items presented on the site are subject to stock availability. Any order is subject to subsequent confirmation.

If the product is unavailable, Microgreens commits to informing the customer, advising a similar product, or refunding the amounts spent.

Missing items may be replaced with a similar one.

Prices should be understood in euros, including taxes and fees. The prices presented take into account the VAT applicable on the order day. Any modification of the applicable VAT rate will be reflected in the product prices. Prices and specifications are subject to change without notice.

For international orders, prices may vary according to local taxes and import duties applicable in each country. Import duties are not included in the purchase price and are the customer's responsibility.

Special promotions or campaigns launched on the www.microgreens.pt portal only apply to orders placed online.

 

DELIVERIES

Microgreens delivers to Portugal, Spain, France, Germany, Italy, Austria, Luxembourg, the Netherlands, Belgium, and Denmark. Delivery times may vary depending on the destination. Check our FAQ page for specific details on delivery times and conditions in each country.

 

PAYMENTS

All orders placed through the www.microgreens.pt store that are not paid within a maximum period of 8 days will be canceled. Payment must be made by 2:00 p.m. on the day before the chosen shipping date.

The customer will have three payment methods at their disposal:

 1 - Multibanco: a Multibanco reference will be generated by Easypay, which will be the name that appears on the entity.

 

2 - Mbway: the customer will receive an authorization request in the Mbway app or from their bank to authorize the payment. After making the payment request, they only have 3 minutes to accept it in the app. If it expires, they can request the payment again.

 

3 - Visa / Mastercard: the customer can also pay with a credit or debit card, Visa or Mastercard.

The entire operation of selecting the payment method to be used and entering the data inherent to the payment process of the order is properly protected.

 

DELIVERIES AND DISTRIBUTION

Any order placed and paid by 2:00 p.m. will be dispatched the same day, being delivered whenever possible the next business day, until 5:00 p.m., from Tuesday to Friday, or according to the delivery schedule of the chosen shipping method. In case of any unforeseen events, we will contact the customer as soon as possible.

 

QUALITY, TRANSPORT, AND DELIVERY POLICY

Microgreens offers a wide range of microgreens, edible flowers and leaves, and mini vegetables, guaranteeing the highest quality of its products.

The order is prepared on the day of dispatch to ensure the product arrives as fresh as possible at the final destination.

Any order placed and paid by 2:00 p.m. will be dispatched the same day, being delivered according to the chosen shipping method, as explained on our FAQ page. In case of any unforeseen events, we will contact the customer as soon as possible.

 

RETURN AND SATISFACTION POLICY

The customer has a period of 15 (fifteen) days from the date of receipt of the order to return the ordered items if they do not fully meet their expectations, according to Decree-Law No. 143/2001 and Decree-Law 82/2008 of 20/05.

In the case of product returns, microgreens.pt refunds the total value of the merchandise, except for perishable items, which cannot be returned unless they suffer changes in their organoleptic characteristics during transport.

In these cases, if the customer detects any imperfection or damage to the product, they should immediately contact Microgreens, which will quickly resolve the problem. All products sent must be examined by the customer immediately upon receipt. If the transport box is damaged or closed with carrier tape, the guide must be signed, writing "Damaged box" or "Closed with carrier tape," and if possible, a photograph showing the damage should be taken to activate the insurance.

If no one is at the delivery address, the address is incorrect/incomplete, and/or there is no response to our contact, the merchandise returns to the transport company's facilities, and the customer will be contacted to schedule a new delivery date. In this case, the customer will lose the return option even if the product shows changes in its organoleptic characteristics, as the delivery time will be longer than anticipated and guaranteed by Microgreens and the carrier.

Microgreens disclaims any responsibility for any errors published on the portal due to technical anomalies. In processing your order, any price error that may be presented on the portal will be detected. In this situation, the customer will be contacted. If the product's price presented on the portal is actually lower, the difference will be refunded. If the price is higher, the customer will be contacted and can accept or cancel the order.

 

INTELLECTUAL PROPERTY

All elements of the virtual store www.microgreens.pt, whether visual or sound, including the underlying technology, are protected by copyright, trademark, or patent rights. They are the exclusive property of Microgreens Unip Lda. A customer who has a personal Internet portal and wishes to place a simple direct link to the homepage of the www.microgreens.pt portal for personal use on their site must request authorization from www.microgreens.pt. This will not be considered an implicit agreement of affiliation or partnership. On the other hand, any hyperlink directed to the www.microgreens.pt portal using framing or in-line linking techniques is formally prohibited. In all cases, any link, even tacitly authorized, must be removed with a simple request from www.microgreens.pt.

 

ENTIRE AGREEMENT

These general sales conditions constitute the entire agreement between the parties. If any clause of these conditions becomes null and void due to a legislative, normative change, or court decision, this will not affect their validity and compliance.

 

DURATION OF THE CONDITIONS

These conditions apply throughout the duration of the services offered by www.microgreens.pt.

 

APPLICABLE LAW AND JURISDICTION

Microgreens is not responsible if import taxes are applied in the country of purchase, being the customer's responsibility.

The sales conditions and any arising disputes are subject to Portuguese law unless otherwise specified by local laws in the delivery countries. In case of conflict, efforts will be made to resolve the issue amicably before proceeding judicially.
